These Terms of Service govern your use of folksom.co.uk and the sale of goods through this site. Please read them carefully. By placing an order, you agree to be bound by them.

In these terms, "we", "us" and "our" mean DM Brands Limited. "You" and "your" mean the customer using the site.

2. Who can buy from us

Our retail storefront is intended for consumers based in the United Kingdom and the international destinations listed on our Shipping page. You must be at least 18 years old to place an order.

If you are buying for a business, please contact our trade team at trade@folksom.co.uk — trade terms differ from these consumer terms.

3. The contract between us

When you place an order, you are making an offer to buy. We accept your offer (and form a contract) when we send you an order confirmation email. Until that email, no contract exists, and we may decline to accept an order — for example, if a product is out of stock, if the price was incorrectly listed, or if we suspect fraud.

If we decline, any payment taken will be refunded in full.

4. Prices and payment

All prices are shown in pounds sterling (GBP) and include UK VAT at the current rate (20%). The price you pay is the price displayed at the moment you complete checkout, even if the price changes afterwards.

We take payment at the moment your order is placed, through Shopify Payments and the other payment methods listed at checkout. We do not see or store your full card details.

If a product is mispriced on the site (for example, an obvious zero-missing typo), we reserve the right to cancel the order and refund you in full rather than fulfil at the incorrect price. We will always contact you first.

5. Delivery

Delivery costs and timings are set out in our Shipping Policy. Delivery times are estimates, not guarantees, but if we fail to deliver within a reasonable period of order placement (or any specific date you have agreed with us in writing), you have the right to cancel the order and receive a full refund.

Risk in the goods passes to you on delivery. Title passes once we have received payment in full.

6. Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order without giving a reason within 14 days of receiving the goods. We extend this to 30 days as a goodwill returns policy.

7. Faulty or damaged goods

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. If they are not, you have the right to:

  • A full refund within 30 days of delivery (the "short-term right to reject"), or
  • A repair or replacement, or
  • A price reduction or refund if repair/replacement is not possible

Email hello@folksom.co.uk within 7 days of delivery if you receive damaged or faulty goods, ideally with photos. We aim to resolve such issues the same working day.

8. Limitation of liability

Nothing in these terms limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under UK law (including under the Consumer Rights Act 2015)

Subject to that, our total liability to a consumer for any loss arising in connection with an order is limited to the price you paid for the goods. We are not liable for indirect or consequential losses.

These terms do not affect your statutory rights as a consumer.

9. Intellectual property

All content on folksom.co.uk — text, photography, design, logos — is owned by DM Brands Limited or our brand partners and is protected by copyright. You may not reproduce it without our written permission, except for normal personal browsing.

Product names, logos and designs of our partner brands (Räder, Remember, My Flame, Relaxound, Ideas4Seasons, Elvang, GEFU, PPD) remain the property of their respective owners and are used under our distribution arrangement with them.

10. Promotional codes and offers

Discount codes are valid only for the period and on the terms stated. They cannot be combined with other offers unless we explicitly say so. We reserve the right to refuse discount codes that appear to have been obtained or used improperly.

11. Account security

If you create an account on folksom.co.uk, you are responsible for keeping your password confidential. Please contact us straight away if you suspect any unauthorised use.

12. Privacy

We handle your personal data in accordance with our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version on the site at the time you placed it.

14. Governing law and disputes

These terms and any order placed through folksom.co.uk are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any disputes.

If you are a consumer and we cannot resolve a complaint to your satisfaction, you may be able to use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
